By accessing, browsing, or using the Site, or by purchasing any products, you agree to be bound by these Terms and our Privacy Policy,(link to PP) which is incorporated by reference. If you do not agree, you may not access or use the Services.

2. ELIGIBILITY

You must be at least 18 years old to use the Services or make a purchase. By using the Site, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.

3. PRODUCTS AND SERVICES

MAXXING offers skincare and supplements products intended for personal use only. All products are subject to availability, and we reserve the right to modify or discontinue products at any time without notice.

7. SUBSCRIPTIONS

If you enroll in a subscription service:

  • You authorize recurring charges to your payment method
  • Subscription charges will occur at the frequency disclosed at checkout
  • You may cancel or modify your subscription according to the terms presented at signup

8. USER ACCOUNTS

If you create an account:

  • You are responsible for maintaining confidentiality of login credentials
  • You are responsible for all activity under your account
  • You agree to notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts at our discretion.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO MAXXING INC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless MAXXING  INC, its officers, directors, employees, and affiliates from any claims, damages, liabilities, costs, or expenses arising from:

  • Your violation of these Terms
  • Your misuse of the Services
  • Your violation of any law or third-party rights

16. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by and construed in accordance with the laws of the State of New York  without regard to conflict-of-law principles.

Any disputes shall be resolved exclusively in the state or federal courts located within that state, and you consent to such jurisdiction.

17. ARBITRATION AND CLASS ACTION WAIVER

At Maxxing’s discretion, disputes may be resolved through binding arbitration rather than court proceedings. You agree to waive any right to participate in class actions or representative proceedings.

18. TERMINATION

We may suspend or terminate your access to the Services at any time, without notice, for conduct that we believe violates these Terms or is harmful to Maxxing or others.

19. CHANGES TO TERMS

We reserve the right to update these Terms at any time. Changes will be posted on the Site with an updated “Last Updated” date. Continued use of the Services constitutes acceptance of the revised Terms.
