By submitting a review, testimonial, photo, or other content to our Site, you grant MAXXING LLC a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, display, and distribute that content in connection with our business and marketing.
You represent that your submissions are truthful, reflect your honest experience, and comply with the Federal Trade Commission's Endorsement Guides. You must disclose any material connection to MAXXING LLC (e.g., if you received a free product in exchange for a review). Fake, fraudulent, or misleading reviews are strictly prohibited and may result in removal and account termination.

17. DISPUTE RESOLUTION AND ARBITRATION
17.1 Informal Resolution
Before initiating any formal dispute resolution, you agree to first contact us at support@trymaxxing.com to attempt to resolve the dispute informally. We will make good-faith efforts to resolve any issue within 30 days.
17.2 Binding Arbitration
If we cannot resolve a dispute informally, you and MAXXING LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or your purchase of products shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the State of New York, or at another mutually agreed location, or via telephone or video conference.
17.3 Class Action Waiver
YOU AND MAXXING LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims.
17.4 Exceptions
Either party may bring claims in small claims court if the claim qualifies. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent intellectual property infringement or unauthorized use.
18. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
19. SEVERABILITY
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
20. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and Cancellation Policy, constitute the entire agreement between you and MAXXING LLC regarding your use of the Site and purchase of products.
